Booking Properties & Holiday Accommodation Terms

The Purpose

These are the General Holiday Accommodation Terms and Conditions  (hereinafter: Terms).  These terms regulate mutual rights and obligations related to booking properties, rooms and other accommodation.  The properties regulated by Terms (hereinafter: properties).  They are considered to be holiday accommodation.  Properties are listed by various property owners.  Also managers and also operators maybe list them.  Mallorca Yachts and Property (Hereinafter agent) operates as Agency-Mediator for booking properties.  Your contract will be with the property owner.   Therefore these conditions detail the terms which apply to your booking through us.

These Terms and all stipulations stated in them shall be the subject of legal liability.  These terms are also binding for the Client who accommodates the properties (hereinafter: Client). Confirming the booking or paying in advance confirms agreement to Terms.

Contract

Your contract of accommodation is with the owner of the property.  This is clearly stated in your contract and also your invoice.  Consequently your contract of accommodation is not with Agent.  You will be required to sign a copy of this contract.  Please ensure you read it closely and also understand its contents.  Agent shall answer questions where required.  Please note that all contracts which mention agent’s name are reference to the agent’s role only.  Therefore any dispute will be with the owner.

Website accuracy

We take all steps practically possible to ensure that the details given to you on our website are accurate.  Also to ensure those details up to date.  However, we do rely upon the descriptions given to us by the actual owners.  Therefore, we will be able to confirm your expectations when you make your enquiry.

Booking Enquiry

You can book by completing the enquiry form with your phone number.  As a result we will call you to discuss your requirements ASAP.

Additional services – Extras

Additional services and packages for which an extra payment shall be made (hereinafter: Extras).  In accordance with the accommodation owner’s price list, extra’s should be requested in writing.  Furthermore, client must agree extras prior to booking confirmation.

Client may ask for addition of certain Extras even after the booking confirmation.  As a result agent will undertake reasonable effort to organize the requested Extras.  Furthermore Agent will will confirm if it is either possible to add extras or not.  Client acknowledges that we are not obliged to provide newly extras at that point in time.

Exclusive Booking Confirmation

When you confirm your booking, we will send you a contract by fax or e-mail.  As a result, account details and payment instructions will be sent.   Sent either with the agent’s contract or a pro-forma invoice.  Either the contract or invoice will come from the accommodation owner.  Your option (tentative reservation) will be held a few days more.  This is because we need to allow enough time for the payment to arrive.   Your booking will not be considered complete until payment is received.

Payments

Once you receive the contract, please sign it and transfer payment and return a signed copy to us either by email or fax.  Payment terms will be stipulated in the contract.  Payment deadlines must be met.  If deadlines expire we cannot guarantee the accommodation will be available once we receive your payment.   Client accepts to pay full costs of the bank transfer charges.  Also when making the payment, client should inform either his or her bank that all bank fees (of both outgoing and incoming bank) should be paid by Client.  If Client fails to do so maybe the agent will be charged bank transfer fees as a result.  If Agent receives charges as a result of client not complying with terms it will be considered that the payment is not fully settled.  In addition, consequently, Client will finally need to settle the remaining amount.

Holiday accommodation reservation will be agreed in writing.  As a result only payments according to amounts, dynamics and instructions stated in our agency agreement are due.  Alternatively the owners pro forma invoice and also any additional documentation which agent has sent to Client.  Until the terms are honoured your booking will not be considered complete.  In addition the owner reserves the right to accept bookings from other guests.  Please read the payment due dates.  As a result avoid missing due dates in order to ensure payments reach us in good time.  This is because payment is not complete until it reaches the accommodation owner’s account.  Please allow time for us to forward your payment.

Finally, on receipt of your payment, the owner may contact you to confirm your booking

The Price of Holiday Accommodation and packages

The value of your purchase includes VAT valid at the time of booking confirmation.   This is because, the relevant VAT / IVA rate could be changed by law.  As a result of a change maybe the agent’s costs will increase.  Therefore agent reserves the right to charge the VAT / IVA difference to client.

In uncommon cases agent has unusually high processing costs.   Therefore a small part of this cost may be charged to the Client as Operative Costs.  In such cases, this Operative Cost will be separately stated and visible on the Pro-forma invoice.

Cancellations

Cancellations must be made in line with the terms in the contract.   Therefore Terms require your signature in your booking agreement.  We strongly advise that adequate holiday insurance, is obtained at the time of booking.  In addition we recommend insurance which includes cancellation cover,

Accommodation and extras substitution

On rare occassions maybe the booked accommodation is unavailable.  As a result all owners reserve the right to substitute a replacement accommodation or extra.  This may be due to damage, breakdown and similar events.  It is the responsibility of guest to communicate with owner after booking.   Therefore ensuring everything is in order.  Also finally confirming that guest understand the owners refunds policy.

Refundable Security Deposit

Sometimes a security deposit is required on a property.  This is probably the same as the amount of excess (uninsured deductible).   This is maybe shown on the properties insurance policy.  Furthermore it is also shown in addition on your invoice. Consequently this covers loss or damage to the property and also its equipment.  It is usually payable on arrival and will be refunded in full on departure.  This will be as a result of leaving the property in good condition.  This is accounting for reasonable use and wear and tear.
